Service Description
Maine Pest Control provides professional pest management and extermination services to residential and commercial clients throughout the State of Maine. Our services include, but are not limited to, inspection, identification, treatment, and monitoring of pests such as insects, rodents, wildlife, and other nuisance organisms. Specific treatment methods, frequencies, and coverage areas are determined based on individual property assessments and the service agreement entered into with each client. All services are performed by licensed technicians in accordance with applicable Maine state regulations and industry standards. We reserve the right to modify service protocols based on environmental conditions, pest behavior, regulatory changes, or safety considerations without prior notice.
No Guarantee or Warranty
Maine Pest Control does not guarantee complete elimination of all pests from any property. Pest management outcomes depend on numerous factors beyond our control, including but not limited to: structural conditions of buildings, neighboring property conditions, weather patterns, seasonal pest migrations, client cooperation, and re-infestation from external sources. We do not warrant that our services will prevent future infestations or that treated areas will remain pest-free indefinitely. Any recommendations for structural repairs, sanitation improvements, or environmental modifications are advisory only, and failure to implement such recommendations may compromise service effectiveness. Written service agreements may specify limited warranties for particular programs; absent such express written terms, all services are provided without warranty of any kind, express or implied.
User Responsibilities
Clients must provide accurate information regarding property conditions, pest activity, and any known hazards prior to service. You are responsible for preparing the service area as instructed, which may include removing pets, covering food preparation surfaces, securing valuables, and ensuring technician access to all relevant areas. Failure to follow preparation guidelines may result in service delays, additional charges, or reduced treatment effectiveness. You must promptly report any adverse reactions, pest recurrence, or concerns following treatment. Children and pets must be kept away from treated areas for the duration specified by technicians. Clients with chemical sensitivities, allergies, or health conditions must disclose these prior to service. You may not interfere with treatment applications, tamper with installed monitoring devices, or apply additional pesticides without consulting Maine Pest Control.
Limitation of Liability
To the maximum extent permitted by law, Maine Pest Control shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, loss of use, lost profits, or emotional distress. Our total liability for any claim shall not exceed the amount actually paid by you for the specific service giving rise to the claim in the twelve months preceding the incident. This limitation applies regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise. We are not responsible for damage to personal property, landscaping, or structures resulting from necessary service activities, pre-existing conditions, or your failure to follow instructions. You agree to indemnify and hold harmless Maine Pest Control, its officers, employees, and agents from claims arising from your negligence, breach of these terms, or misrepresentation of material facts.
Intellectual Property
All content on our website, marketing materials, service reports, treatment plans, and proprietary application techniques are the exclusive intellectual property of Maine Pest Control. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any materials without our prior written consent. Service reports and documentation provided to you are for your personal, non-commercial reference only. Our trade names, logos, and service marks are protected under applicable trademark laws. Unauthorized use of our intellectual property constitutes infringement and may result in legal action.
Governing Law
These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Maine, without regard to its conflict of law principles. Any legal action or proceeding relating to our services must be brought exclusively in the state or federal courts located within Maine. You consent to the personal jurisdiction of such courts and waive any objection to venue in these forums. The provisions of the Maine Uniform Commercial Code shall apply where relevant. If any provision of these terms is found invalid or unenforceable under Maine law, the remaining provisions shall continue in full force and effect.
Changes to Terms
Maine Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without individual notice. Changes become effective immediately upon posting to our website or other written notification. Your continued use of our services following any changes constitutes acceptance of the modified terms. Material changes affecting existing service agreements will be communicated directly to affected clients where required by law. We encourage you to review these terms periodically.
